01These terms
Raku Technologies Pty Ltd (ABN 80 635 175 843), "Raku", "we" or "us", provides this website and Sight: the
console at sight.raku.so, its API and its SDK. By creating an account or using them you agree to these
terms. If you use Sight for an organisation, you agree on its behalf and confirm you are allowed to.
If you have a signed agreement with us, that agreement applies where it differs from these terms. How we
handle personal information is set out in our Privacy Policy.
02Your account
- Give accurate details and keep them up to date.
- Keep your sign-in and your API keys secret. An API key belongs on a server, never in a phone app or a web page.
- You are responsible for what is done with your account and your keys, including by people you invite.
- Tell us at once if you think an account or key has been used without permission.
- You must be 16 or older.
03Your photos and labels
You keep all your rights in the photos, labels, check rules and other material you put into Sight ("your
content"). You give us permission to store, copy and process your content only as needed to provide and
support the service for you: to check your photos, train and run models for your account, show you
results, and fix problems.
- We do not use your content to train a model for a different customer unless you agree.
- We do not sell or publish your content.
- You confirm you have the right to upload your content, including any permission needed from people who appear in photos or whose property is shown.
- You can remove photos, and ask us to delete your content, at any time.
The sample sets we offer for learning come from third parties under their own licences, which are stated
with each set. Those licences apply to your use of them.
04Models and results
Sight trains models on your content and runs them for you on our systems. While your account is open you
may use those models, through the console and the API, within your plan's limits. Results (detections,
readings and verdicts) produced for your account are yours to use.
Sight's answers are produced by software and can be wrong. A verdict of pass, fail or needs a person is
information to help you decide. It is not a certification, an inspection, or professional, engineering or
safety advice. You remain responsible for decisions about safety, quality and compliance, and for having
a person check where the consequence of a mistake is serious.
05What you must not do
- Break the law, or upload content you have no right to use.
- Use Sight to identify people from their faces or bodies, or to watch people in a way the law does not allow.
- Upload sensitive information about people, such as health information, unless we have agreed to it in writing.
- Try to get around limits, security or access controls, or use another customer's account or data.
- Copy, reverse engineer or extract our software or models, except where the law says you may.
- Resell the service, or use it to build a competing service, without our written agreement.
- Overload or disrupt the service, or use it to send malware or abusive content.
06Plans, limits and fees
Each plan has limits, such as how many models, training runs and predictions it includes. The current
plans and prices are on the pricing page, and the console shows what your project
has used.
- The Free plan costs nothing. We may change what it includes, with notice.
- Paid plans are set up with us and billed as agreed with you at the time. Fees already paid are not refunded unless the law requires it or we agree.
- We will tell you before a price you are paying goes up, and you may leave before it takes effect.
- Features marked beta are still being finished. They may change, and they come without the commitments that apply to the rest of the service.
07The service
We work to keep Sight available and accurate, and we will tell you about planned work that affects you
where we can. We do not promise that it will be uninterrupted or free of errors, and training runs wait
their turn. We may change or withdraw features; if a change removes something you rely on in a paid plan,
we will give you reasonable notice.
08What is ours
We and our licensors own the website, Sight, its software, its documentation and the Raku and Sight names
and marks. These terms give you the right to use the service; they do not transfer ownership of any of
it. The Sight SDK is open source and is covered by the licence published with it.
If you send us ideas or feedback, we may use them without owing you anything.
09Responsibility and liability
Your rights under the Australian Consumer Law are not excluded or limited by these terms. Where that law lets us limit what we owe for a failure of a guarantee, we limit it to supplying the
service again or paying the cost of having it supplied again.
Beyond those rights, and as far as the law allows:
- the service is provided as it is, without other promises about fitness for a particular purpose;
- we are not liable for indirect loss, lost profit, lost revenue or lost data;
- our total liability to you in any twelve months is limited to the fees you paid us in that period, or one hundred Australian dollars if you paid none.
You agree to cover our reasonable loss if a claim is made against us because of your content or because
you broke these terms.
10Ending
You may stop using Sight and close your account at any time. We may suspend or close an account that
breaks these terms, puts the service or other customers at risk, or has been unused for a long time, and
we will tell you first where that is reasonable.
When an account closes, your right to use the service and the models in it ends. We delete your content
on request, as our Privacy Policy describes.
11Changes to these terms
When we change these terms we change the date at the top. If a change matters to you, we will tell Sight
account holders by email before it takes effect. Carrying on using the service after that means you
accept the change.
12Law and contact
These terms are governed by the law of Victoria, Australia, and the courts of Victoria decide any
dispute. If part of these terms cannot be enforced, the rest still applies.
